Terms and Conditions

I . Refundable Damage/Security Deposit and Condo Rental Fee Payment

Upon booking, we require that a Damage/Security Deposit of $200.00 is provided. This deposit is to cover any loss or damage to the property caused by Guest as well as charges that incur as a result of extra services not provided by the amenities in the condo, such as long distance calls to countries or mobile phones not included in the 60 countries listed, or Pay-Per-View TV and any additional paid TV channels not originally subscribed.

Condo rental fee must be received on or before 30 days of your arrival. We will try best to remind you near the 30 days that full payment is due, however, if payment is not received by such time, we can not guarantee your booking dates.

Refundable Damage/Security Deposit and Condo rental fee invoices will be sent to you via PayPal invoices, which you can pay using your major credit card. Please note, PayPal incurs 2.9% transaction charges and/or fee. Visit PayPal.com to review details. This is our preferred method of payment.

We also accept other method of payment by Certified Checks, such as Cashier's Check, Money Order or Bank Draft drawn in US Dollar. This method of payment takes longer and the check must be cleared in our Canadian bank.

Personal Checks and payment method by Western Union and MoneyGram transfer are NOT accepted

II. Cancellation Policy

Cancellation must be notified to us by writing as soon as possible, and we will be happy to refund your payment with the following condition:

From 4 weeks or more before arrival date = Full refund

From 2 - 3 weeks before arrival date = 75% refund

From 1 week before arrival date = 50% refund

Less than 1 weeks before arrival date = not refundable. Understand that the likelihood of us finding renter in this short period of time is unlikely.

No refunds on payment will be given if Guests (renter) elect to leave their property early.

Your Damage/Security Deposit of $ 200 to be refunded in full no later than one week after departure via PayPal, providing there is no damage to the condo or any other extra charges mentioned on Section I above.

III. Substitutions

Should our condo become unavailable due to emergency maintenance issues (i.e. broken air conditioning or water pipes) that would prohibit us from putting Guests in our condo, we will try to find comparable accommodation in Terrace Ridge community first. If there is none available, we will then try to find comparable accommodation in other communities within Davenport or Kissimmee area.

If Guest choose to receive the entire payment (Refundable Damage/Security Deposit and Condo Rental Fee), we will do so accordingly.

Please note that other accommodations are owned individually by different owners thus subjected to their own terms and conditions.

IV. Damage to the Condo

Any loss of content or damages to the condo caused by Guest in excess of normal wear and tear is to be reported to us immediately (within 24 hours). We will contact our local Property Manager, and if necessary contractor in the area, to inspect, assess the damage and estimate cost of repair or replacement. If cost of repair/replacement is estimated to be less than $200, we will use Damage/Security Deposit to cover it, however, if loss or damage is estimated to be more than $200 to repair or to replace, it is a term and condition of your reservation that you agree to pay for the invoice for the damage until original condition of the damage is achieved or replacement is found to be satisfactory. A copy of the paid repair/replacement invoice will be mailed to Guests.

In the event of any dispute relating to damage to the condo, the parties agree that said dispute will be resolved in the appropriate state court having jurisdiction in Polk Counties, Florida and the prevailing party shall be awarded its reasonable attorney’s fees and costs against the non-prevailing party both at the trial and appellate level. Formal service of process is waived and may be accomplished by certified mail, return receipt requested or DHL or any other international method of mail delivery with a receipt showing delivery. Service shall include a copy of any relevant complaint and summons.

V. Cleaning

While Guests are not expected to clean our condo, it is a term of your reservation that you agree to leave the condo in a tidy and acceptable standard. An unacceptable standard is defined as leaving the premises measurably different from check in. This includes, but is not limited to, moving furniture, leaving behind large quantities of personnel possessions or trash, or not cleaning up vomit or other bodily fluids.

If the condo sustains damage, large permanent stains on sofa, bed, walls, etc and/or is not left in an acceptable standard upon checkout, the Guests are legally responsible to refund the Owner for the expense in rectifying the problems, and we will use your Damage/Security Deposit for this purpose. If the cost exceed $200, it is a term and condition of your reservation that you agree to pay for the invoice for the damage or extra cleaning.

VI. Telephone Service

Our Condo is equipped with high quality VOIP (Voice Over Internet Phone) telephone services which include local and long call distance to more than 60 countries. Charges will apply to calls to countries or mobile outside the mentioned 60 countries. Refer to "House Manual" binder in the condo for rates per minute for these countries.

This telephone service is for your enjoyment to call family or friend back home, and not to be used for commercial or business transaction.

VII. TV Services

We subscribe to Frontier cable TV which provides dozens of channels for all ages. We do not subscribe to adult X-rated movies. We blocked these type of channels to prevent children from switching to these movies by accident. We also blocked Pay-Per-View channels for the same reason. Do NOT call Frontier to have these channels unblocked. Give us a call if you have any concern regarding TV services. If call is still made to Frontier to unblock these channels, Guest will be charged using Damage/Security Deposit, the cost of the TV program plus the cost for blocking these channels again, and applicable taxes.

VIII. Check In and Check Out

Florida Law requires that all Guests inform their presence at the rental property. Please let our property manager knows that you have arrived at our property and provide them with your name and contact information. We employ professional property management, Easy Choice Property Management, who will record your information and forward to us. Easy Choice will also be your main contact if any emergency maintenance that may arise during your stay.

Check-in begins at 4 PM. Call us to see if the condo is available early, however, an early check-in is NOT guaranteed.

Check out time is by 10 AM at the latest. Understand that the next guests are expecting the same cleanliness and comfort that you have experienced, and the condo must be cleaned entirely by our professional cleaners which will take some times. Towards the end of your stay you may request late check out, however we do not guarantee this will be possible.

Please note that our condo is equipped with keyless lock system which requires access codes to unlock the condo door. This numerical access code only operational during your stay, starting at check-in time and expires at check-out time. Do not share this access code to anyone you do not know.

IX. Minimum Stay Length

During peak season, including Easter and Christmas, we have a 5 night minimum stay for all properties. In some cases, we will work with you if you have a shorter stay, but it is the discretion of us.

X. Property Occupancy Limits

The maximum number of persons allowed in our condo is six people. Children are counted, unless under the age of (3). This represents the total number of people allowed to occupy the property inside or outside, day or night. Please note that Florida law puts strict limits on the number of occupants permitted to stay in vacation homes. Please note that the authorities police this law and that they have the powers to spot-check homes at any time for infringement. In the event of higher occupancy than that permitted, you will be required to vacate the property immediately. If this occurs, there can be no refund of the rental payment, and any deposit paid will be forfeited.

XI. Minimum Age

We require that there is at least one person over the age of 25 years old. Guests found breaking this condition will be required to leave the property and no refund of any sort will be given.

XII. Swimming Pool

Community swimming pool is available by the Club House. Guests are expected to follow rules posted by the swimming pool and Owners do not accept any liability for any injury, however caused, as a result of the use of the pool. Guests are specifically requested not to allow unsupervised children to use the pool. Local laws apply.

XIII. No Smoking, Pets, or Firearms

Our condo is a non-smoking properties. If you smoke we request that you do so outside. If you do smoke inside the property you will be charged $150.00 to have the house shampooed and deodorized. Thank you for your help and understanding.

Please note that pets are not permitted in our condo unless prior arrangements have been made and the pet deposit is received. If it is discovered that a pet has been in our condo, there is an automatic charge of $150.00 to cover the cost of professionally cleaning all carpets and upholstery. There is an additional charge should a pest control company's services be required. You will also be asked to leave our condo, forfeiting your stay and any payments or deposits made.

Firearms of any kind are prohibited in our condo. If a firearm is discovered in the premises, you will be asked to leave, forfeiting your stay and any payments or deposits made.

XIV. Trash

Trash collection days will be posted inside the condo for your review. Trash must be placed in the bins provided outside the condo by 7:00 am the morning of collection. If there is excess of trash on departure due to not putting trash out there will be a $50 pick up charge.

XV. Consumable Items

In making your reservation, you understand that your vacation will be self catering in nature. We do not provide consumables items. We provide one roll of toilet paper per bathroom at the beginning of your vacation. These will not be renewed. It is the responsibility of the Guest to provide items such as washing up liquid, dishwasher powder (see folder in our condo), washing machine powder, toilet paper, soap, shampoo etc.

XVI. Construction Work

Guests recognize that Central Florida and, in particular, the Disney World area is growing and expanding quickly. As a result there is a lot of construction work in progress. Guests accept as a term of their reservation that construction work may be present near our vacation condo. If this occurs, guests may ask that they be moved to a new vacation home. However, this is only a request and can not be guaranteed. Compensation will be refundable at the discretion of owner and there is no right to compensation on the part of the guest.

XVII. Insects

Florida is a tropical state and as such insects and small creatures are inevitable and are not a cause for complaint. Their presence is no reflection on the cleanliness of the property. Our condo is treated regularly as part of a pest and termite control program. We advise you to keep all windows and external doors closed whenever possible; not only will this help keep bugs from the property but it will also enable the air conditioning unit to function more efficiently.

XVIII. Travel and Health Insurance

Guests are advised to have appropriate travel/medical insurance in force for the period of rental. All matters arising with regard to loss or injury should be directed to the respective insurance company.

XIX. Personal Safety

The owners cannot accept any liability for your personal safety during your residency at the rental property. Guests are reminded to exercise care as to personal safety of themselves and all party members. Whenever possible, valuables should be left secure and out of sight. Guests are not to give Gate Code to Terrace Ridge community to stranger. We all agree to keep Terrace Ridge community safe and sound.

XX. Special Conditions

As the owner of condo and our Property Manager or its agents, will not be liable for any loss or delay occasioned by any of the following; strikes, riots, political unrest, war or the threat of war, terrorist activities, industrial disputes, fire, flood, technical/weather problems to transport, aircraft, closure of airports, or any other event beyond the owner's control.

XXI. Responsible Party

The person who makes the reservation and whose name is on the confirmation documents is the lead name. The lead name must travel with the group. The lead name is solely responsible for the reservation. This includes but is not limited to responsibility for damage to condo and making payment at check in and payments for deposits. We will only take instructions relating to the reservation from the lead name. Please note that the lead name will be responsible for payment for damage etc, even if they did not cause it, if it was caused by a member or their party / group.

XXII. If We Cancel Your Reservation

In the event of circumstances beyond our control requiring us to cancel a reservation, i.e. acts of God, civil disturbances, riots, flood, drought, fire and legislation, only repayment in full of any monies paid in respect of the reservation will be made. We will do everything in our power to find suitable alternative accommodation, however we can accept no liability whatsoever in respect of any loss or damage sustained in these circumstances.

XXIII. Maintenance Issues

Our main priority is to please you. If our condo encounters unexpected maintenance problems, we will do everything within our powers to fix the problem within twenty-four hours of it being reported. It is a term of your reservation that you accept things can go wrong and cannot always be fixed during your stay or within 24 hours. If this should happen, refunds will only be given at the discretion of owner. The ONLY exception to this is if the air conditioning fails or main water pipes burst or if there is a power outage caused by the utility provider (Progress Energy). Alternately, we will try to find comparable accommodation as substitute, see Section III above, if maintenance issue require extensive and long time to repair.
